Confidentiality is a fundamental component of every engagement at CORE MedLegal Consulting, LLC.
We understand that legal matters may involve protected health information, privileged attorney communications, confidential work product, sensitive litigation strategy, and personally identifiable information. Case materials are handled with discretion and through systems designed to support secure communication, document transfer, storage, and review.
Confidential Case Handling
At CORE MedLegal Consulting, we prioritize confidentiality in every case we handle. Our team ensures that all sensitive information is protected throughout the consulting process.
Secure Communication and Document Transfer
CORE MedLegal Consulting uses secure systems for client communication and case-material exchange, including:
- Encrypted email services supported by applicable vendor agreements
- Dedicated secure fax services
- Protected cloud-based document transfer
- Password and access controls
- Multi-factor authentication where available
- Secure storage of electronic case materials
Specific transfer instructions are provided after the initial consultation and conflict review.
Access Controls
Access to client communications and case materials is restricted to individuals with an authorized role in the engagement.
Internal safeguards may include:
- Role-based access
- Unique account credentials
- Device security
- Controlled file-sharing permissions
- Secure document storage
- Limited retention of case materials
- Secure deletion or return of records when appropriate
Protected Health Information
Clients should not submit patient names, dates of birth, medical records, photographs, or other protected health information through a general website inquiry form unless specifically instructed to do so through an approved secure channel.
The initial contact form should be used only to provide:
- Attorney or firm contact information
- General case type
- Provider specialty
- Relevant deadlines
- Approximate record volume
- A brief description that does not identify the patient
Secure upload instructions will be provided when record transfer is appropriate.
Business Associate Agreement
When the nature of the engagement requires a Business Associate Agreement or other confidentiality documentation, the applicable requirements should be addressed as part of the engagement process.
The applicability of HIPAA depends on the parties, information, relationship, and purpose involved. Secure handling practices are maintained regardless of whether a particular engagement is legally subject to HIPAA.
Attorney-Client and Work-Product Considerations
The retaining attorney should determine whether communications, reports, drafts, or consultant work are intended to be protected by attorney-client privilege, attorney work-product doctrine, consulting-expert protections, or other applicable law.
CORE MedLegal Consulting follows the retaining attorney’s instructions regarding:
- Distribution of reports
- Communication with third parties
- Identification of consulting or testifying roles
- Handling of draft materials
- Retention or destruction of files
- Public filing or disclosure of medical information
